Disclaimer

The products you order on afremov.com cannot be considered an “ investment “. The majority of the products are recreations made by hand with oil on canvas by Afremov Studio artists and giclee prints. These are beautiful and handmade “ decorations” and are priced accordingly. The only paintings that can be considered an “investment” are one-a-kind original oil paintings painted by Leonid Afremov himself. These paintings are listed in the following category https://afremov.com/original-oil-paintings/ only. The paintings and giclee on the site can have one of our registered trademark logos on the front. AFREMOV® or Leonid Afremov stylized logo based on the original signature of Leonid Afremov. Studio recreations will have the signature of the creating artist in the backside. Giclees and prints always have the stylized logo Leonid Afremov in the front and/or back. Limited editions always have the stylized logo Leonid Afremov on the front and back. Originals by Afremov Studio artists in the style of the artist Leonid Afremov will have AFREMOV® on the front and the signature of the artist on the back.

Ordering Terms
When you place an order on Afremov.com using Stripe or PayPal payment terminals, you enter into a purchase agreement with Leonid Afremov S. de R.L. de C.V., registered at Rancho San Martin, Calle 2, Lt 112, Akumal, Quintana Roo, CP 77776, Mexico.
When you place an order using Openpay, you enter into a purchase agreement with Afremov Gallery S. de R.L. de C.V., registered at Cerrada Diagonal 85, Bambu M2 L2 UP17, Solidaridad, Quintana Roo, CP 77712, Mexico.

Shipping and logistics are performed by third-party providers in Mexico and China. Some orders may ship directly from the gallery holding the painting or from the artist’s studio. We work with artists in multiple countries.

The Customer must submit proper payment via accepted methods and comply with these Terms and our conduct policies. Afremov.com must process and ship orders according to these Terms and each product’s published description.

Purchase Agreement & Payments
All card transactions are processed on the order date. By accepting delivery of any product sold by Afremov.com, you (“Customer”) agree to be bound by these Terms, which exclusively govern the sale between you and Afremov.com. Any attempt by Customer to alter or supplement these Terms is a material alteration and is null and void. These Terms may change at any time without prior notice; please review them whenever you place an order or accept delivery.

Entire Agreement
These Terms together with the Afremov.com invoice for your order constitute the complete and exclusive agreement between Afremov.com and Customer. They supersede any prior or contemporaneous proposals, understandings, representations, or communications, oral or written, relating to the products. No prior course of dealing or trade usage shall modify these Terms.

Use of Site; Customer & Staff Conduct
Harassment in any form on the site (including email or chat) and the use of obscene, abusive, or threatening language are strictly prohibited. Impersonation of others (including Afremov.com staff or other users) is prohibited. You may not upload, distribute, or publish content that is libelous, defamatory, obscene, threatening, invasive of privacy/publicity rights, illegal, or otherwise objectionable, or that encourages criminal conduct or infringes any right.
Customers must communicate respectfully without profanity, insults, or intimidation. We reserve the right to refuse or cancel orders from customers who violate these guidelines.

Indemnification
You agree to indemnify, defend, and hold harmless Afremov.com, its officers, directors, employees, agents, licensors, and suppliers from any losses, damages, and costs (including reasonable attorneys’ fees) resulting from your violation of these Terms or activity related to your account by you or anyone accessing the site through your internet account.

Typographical Errors
If a product is mistakenly listed at an incorrect price, Afremov.com may refuse or cancel any orders placed at that price, whether or not confirmed and whether or not your card was charged. If charged, Afremov.com will issue a credit for the incorrect amount. Afremov.com is not responsible for typographical or photographic errors. Prices and specifications may change without notice.

Term; Termination
These Terms apply upon accessing the site and/or completing registration or a purchase. Afremov.com may terminate these Terms, in whole or in part, without notice at any time. Provisions relating to Copyrights, Trademarks, Disclaimers, Limitation of Liability, Indemnification, and Miscellaneous survive termination.

Notices & Notifications
Afremov.com may send notices by email, site banners, or other reliable methods to the address you provide. Typical notices include order confirmations, shipping updates, address inquiries, and order-related questions. Your contact information may appear on shipping labels so carriers can arrange delivery.

Governing Law; Venue
These Terms and your use of this site are governed by the laws of Mexico (without regard to conflict-of-law rules) and not by the 1980 U.N. Convention on Contracts for the International Sale of Goods (CISG). You agree that exclusive jurisdiction and venue for any legal proceeding arising out of or relating to this site or the purchase of Afremov.com products shall lie in the courts located in Mexico. Any claim must be commenced within one (1) year after it accrues, to the extent permitted by law.

Participation Disclaimer
Afremov.com cannot review all user content and is not responsible for it. By allowing users to view and distribute user-generated content, Afremov.com acts as a passive conduit. We may block or remove content that we determine, in our sole discretion, to be (a) abusive, defamatory, obscene; (b) fraudulent, deceptive, or misleading; (c) infringing; or (d) otherwise objectionable.

Limitation of Liability
Afremov.com shall not be liable for any special, incidental, indirect, or consequential damages arising from the use of the site or performance of products, even if advised of the possibility. Some jurisdictions do not allow certain limitations; in such cases, the limitation applies to the fullest extent permitted by law.

Order Cancellation Policy
Orders must be canceled by email and confirmed by an Afremov.com representative. You may email your request and follow up by phone. Refused shipments may be subject to shipping and return fees. Afremov.com may cancel and refund any order at any time at its discretion.
Unshipped orders can be canceled upon request. Shipped orders are handled as returns under our Return Policy.

By placing an order by phone, you agree to these Terms.

Sales Tax / VAT / GST / IVA
We may collect and remit taxes where required by law. Orders delivered in Mexico are subject to IVA (16%); Afremov.com remits IVA to the Mexican SAT. Orders to other destinations may incur taxes or customs fees upon delivery, collected by carriers or customs. Customers are responsible for any such charges unless otherwise stated.

Shipping
We aim to deliver most orders within 30 calendar days. Some items ship faster; others are made on demand and may require additional drying time. We will notify you of any material delay.
You will receive an order notice on the next business day from orders@afremov.com with estimated processing and shipping times. If you don’t receive it, check spam or contact us.

Printed merchandise (t-shirts, bags, face masks, phone cases, etc.) ships from our contracted manufacturer with facilities in Mexico, the USA, and Lithuania. Full Shipping Policy: https://afremov.com/Shipping-Policy.html.

Returns
Afremov.com may reject damaged goods or returns that do not meet policy. Refunds/exchanges/store credit are processed after merchandise is received. Items must be in original condition.
Our 30-Day Money-Back Guarantee starts on the delivery date and runs for 30 calendar days (weekends/holidays included). Returns after 30 days receive Store Credit for the payment value.
Within 30 days Afremov.com will email a free UPS/FedEx/DHL return label upon request (international labels available). Return shipping is refunded via our label only; we do not reimburse self-paid returns. Original shipping/handling is non-refundable. Import Duties
For orders outside Mexico (and where applicable the USA), the recipient is responsible for all duties and taxes. If a shipment is refused and returned, outbound and return shipping fees may be deducted from the refund, or additional fees may apply for re-shipment.
Import Duties Compensation (Store Credit): we do not reimburse duties/taxes in cash, but we may provide store credit equal to the tax paid on presentation of a valid receipt (email shipping@afremov.com).

All site content (text, graphics, code, etc.) is protected under U.S. and international copyright laws and is the property of Afremov.com. You may view and print materials for personal, non-commercial use or to place an order. Any other use (copying, reproduction, distribution, display, transmission) is prohibited without written consent. Do not remove proprietary notices.

Art Copyright: Purchasing images/artworks does not grant any copyright or IP rights. You may not duplicate or republish any art or photography for any reason, including commercial purposes. Adding text/alterations does not create joint ownership.

Afremov.com values your privacy. We do not sell your data. We share only what is necessary with shipping providers to fulfill delivery, as outlined in our Privacy Policy. Governing Law; Exclusive Venue
These Terms and any dispute, claim, or controversy (contractual or non-contractual) arising out of or relating to this site or any purchase through Afremov.com shall be governed by the laws of Mexico, without regard to conflict-of-laws rules, and excluding the 1980 U.N. Convention on Contracts for the International Sale of Goods (CISG).
The sole and exclusive forum and venue for any action shall be the courts located in Quintana Roo, Mexico. You irrevocably submit to the personal jurisdiction of such courts and waive any objection to venue or forum non conveniens. Any claim must be commenced within one (1) year after it accrues, to the extent permitted by law.
